The Rules of the Arizona Supreme Court authorize the Clerk of the Superior Court (Arizona state court) to act on applications for the issuance of process and other matters that do not require an 0rder from a Superior Court judge. In other words, the Clerk can issue a summons, a subpoena, and a writ of garnishment, among dozens of other legal documents. The “praecipe” is a commonly used form issued by the Clerk. In it, a litigant for example states the type of case he is filing, the amount of money he is seeking, and whether he is asking for a jury trial. The Clerk of the Court handles dozens of other matters for litigants and judges. There are also Clerks of the Court in Small Claims Court, Justice of the Peace Court, the Arizona Court of Appeals, the Arizona Supreme Court and the United States District Court for the District of Arizona.
